I've had contact with a developer that is working on the EMUI interface. He told me, huawei couldn't roll out the updates to EU for Huawei Mate 7 because of the codecs that need appropriate licenses. Back in the days this included the MP3 codec, DTS, stuff like AAC, MP4 etc. MP3 is libre now, the patent has run out.

This is simply not true, and MP3 codecs were always freely accesible in the EU.

Sisvel holds the patent of MP3 in europe and any devices that are labelled as MP3 or have MP3 capabilites are getting confiscated on the EU border if there's no valid license. It gets a bit complicated working out the exact details of how this is how it is, Sisvel isn't really a company by itself, it is owned by some other company. The fact is, yes, you can patent an algorithm and the implementation of such is not allowed because of the patent. Similar to how you're not allowed to write an RAR compression utility unless you blindcode a different algorithm

Uncompression of RAR is free tho

After all, this kind of witchery shouldn't be dragged into the FLOSS community, which is why we should distance ourselves from implementing such things. Fedora distances itself by not providing patented codecs that are held by patent trolls. Important to know, is, that not all patents restrict use. The Linux kernel and it's algorithms is actually patented too, by the Linux Foundation and companies like RedHat so that noone else can patent it. They have that somewhere in their manifesto that these patents stay free for use always

As programmer you have only two options: closed source or open source. Either you make your code available or not. GPL, Creative Commons, etc.... are licenses. They are matter of philosophers and lawyers rather than programmers and users.

90% of the time, open source software is free software anyway, considered that some decide this based on the license, but even decided based on the morals most open source software is libre.

The issue starts to arise, if third-party libraries get linked as a compile dependency or as part of the code / api whatever. Then you have to understand how free software licenses work and that the released product that contains those proprietary parts is no longer free software, even if parts of the code are.
