the Windows Classic interface is simple enough that it is ineligible for copyright. If themes like Luna or Aero were copied though, that'd be infringement

it's not in any outwardly-facing projects, but they've done tests on wine

lawsuits did fly... mainly between Apple and Microsoft but when Microsoft pointed out that Apple's UI was stolen from Xerox in the first place, Apple lost. xD
